The acting Tabliq Muslim Amir Ummah Sheikh Yahya Mwanje and 3 other people have been today afternoon charged with the murder of Sheikh Maj. Muhammad Kiggundu and his bodyguard at Buganda Road Court in Kampala.
Others charged with him are 2 bodaboda riders from Kyengera Muhammad Buyondo and Abdul -Wahab Ssendegeya and Muhammad Ssekandi, a businesman from Masanafu.
The Buganda Road chief Magistrate James Karemani the four and others still at large that on the 26th day of November 2016 at Masanafu trading center a kampala suburb shot dead Maj. Kiggunduand his body guard Sgt. Steven Mukasa.
He however told them not say anything since such capital offences can only be heard in High court since his has got no jurisdiction
Meanwhile the four through their Lawyer Fred Muwema asked the presiding magistrate to issue criminal summon to the head of Nalufenya Police Station Wilson Omoding, on grounds that police subjected them to both psychology and mental torture in addition to detaining them for more than 48 hours which violated their rights as per constitution and prevention and prohibition of torture act.
The matter has now been adjourned to the 20th of this month when the magistrate will make a ruling whether to issue criminal summon to Omoding.
It should be noted that police arrested sheik Yahaya Mwanje on the night of 27th of November 2016 a day after the two were shot dead.
Subsequently Police on December 27 2016 raided Nakasero Mosque before arresting some people and confiscating computers and documents and since then Muslims have vowed to sue police in the courts of law.
Yesterday the inspector general of police General Edward Kale Kayihura while at Uganda supreme council offices at old Kampala apologized to the Muslim community for mosque raids.
