The high court registrar civil division which sit at Twed towers in kololo has scheduled 28th August 2017 as the hearing dates of the appeal application filed by the Lubaga south legislator Kato Paul Lubwama, challenging Justice Margate Oguli Oumo’s ruling which okayed his voter Buwembo Habib to file an election application challenging the victory of Kato Lubwama.
In a letter copied to lawyers of both parties dated 8th, the hearing will begin at 09:30am further warning that failure for one of the either parties to turn up, the matter will be heard in their absence.
On Monday 7th August, the deputy chief Justice Steven Kavuma ordered this office to expediously allocate the hearing date for the application.
In his ruling read by the deputy registrar Deo Nzeyimana where he (Kavuma) decline to step out of an application filed by Buwembo’s legal team lead by Isaac Ssemakadde Ssemakadde challenging Kavuma’s presence on the panel, claiming he doesn’t expect justice from him citing that the several complaints filed to the Chief Justice challenging Kavuma’s competence and character. Semakadde also had asserted that even though they won’t challenge the ruling, they will not stop questioning Justice Kavuma’s conduct.
It should be noted that in December last year Justice Oumo allowed Buwembo to challenge Lubwama’s academic credentials despite the known period having elapsed which decision is being challenged by the legislator.
This appeal application is assigned to 3 appellant judges including Stephen Kavuma, Hellen Obura and Cheborion Barishaki.
