Court of appeal has upheld the high court decision that retained NRM’s Moses Musamba Nagwomu as the duly elected Member of Parliament for Bunyore East constituency in Butalejja district.
This after the dismissal with costs an election appeal filed by his rival Yusuf Mutembuli the DP chairperson eastern regional claiming that the high court did not fully evaluate evidence on record when it retained him yet he lacked requisite academic papers.
Mutembuli sought nullification of elections on grounds that Nagwomu did not have O level certificate at the time of his nomination and instead presented to the EC a certificate that belonged to his cousin Moses Musamba Nagwomu who is a security officer.
However in their ruling read by the Deputy registrar Deo Nzeyimana the three courts of appeal judges who include; Kenneth Kakuru, Egonda Ntende and Elizabeth Musoke unanimously agreed with the high court decision on grounds that Mutembuli failed to prove any single ground in his petition.
