The Buganda road court under his worship the chief magistrate James Eremye Mawanda has stayed the criminal proceedings against the former Makerere university lecturer Dr.Stellah Nyanzi until the constitutional court disposes off an application she filed last year through her legal team challenging her mental examination as earlier sought by the state.
Nyanzi 42 a Kisaasi resident in Kawempe division a Kampala suburb instructed her lawyers led by Walubiri Peter to file an application requesting for either continued proceedings or disposed off with hearing of offenssive communication and cyber harassment charges pending constitutional or dismiss the proceedings.
However in the last buganda road court session,the state prosecutor Jonathan Muwaganya resisted saying that Buganda road court being a lower temple of justice can not proceed with the hearing of matter in a higher court unless its disposed off.
While delivering his ruling HW Eremye noted that he can’t proceed with the matter before disposal of the constitutional application before cautioning her lawyers to always push for expeditious hearing of the application so as to avoid delays in her trial.
In the same ruling the magistrate has therefore extended bail until the 6/April 2018
