The state minister for transport Gen Katumba Edward Wamala and the attorney general have today been dragged to the constitutional court at Twed towers in Kampala over ministerial position to a serving army officer.
Sentongo Sharif Nambale through his lawyer Luyimbazi Erias Nalukoola of Nalukoola, Kakeeto advocates and solicitors has filed a constitutional petition registered under number 35 0f 2017 with over eleven (11) prayers including nullifying the appointment of Gen Katumba on grounds of being a serving officer, he also wants the court stop the presidents action of appointing serving officers to political or partisan offices.
Nalukoola the lawyer for the petitioner has told our reporter that they also want a declaration that the president, parliament and general Wamala abused the constitution and that general Wamala be ordered to vacate the ministerial position
”The act by the President of the republic of Uganda of appointing serving military officer to a ministerial position is inconsistent with and in contravention with article 2, 208 (2), 209, 17 (k), 210 objective XIX (f) and the preamble to the constitution of republic of Uganda, 1995”. The petition read in parts.
Ssentongo demands that the court should permanently restrain any person or authority from appointing any serving officer of the defense forces to any civilian or political and/ or partisan employment, job or office.
“Permanently restraining any serving officer of the defense forces from seeking approval for serving in and/ or accepting appointment to a political or civilian and/ or partisan office or employment or undertaking, not specifically and expressly Okayed by law” one of the demands in the petition read.
He further demands for all costs which will be spent in the court process be rewarded.
Despite all parties being served, the court has not yet scheduled the hearing date.
