High court judge justice Elizabeth Kabanda has declined to grant bail to Mathew Kanyamunyu, his girlfriend Cynthia Munwagari and his brother joseph Kanyamunyu .

While delivering her ruling justice Kabanda said that though Mathew Kamunyu has a fixed place of abode his two co accused  have not proved this ground since Munwagari is not citizen of Uganda who only holds a work permit while Joseph Kanyamunyu by the time of the application his resident wasn’t clear.

Justice Kabanda also found that all the applicants didn’t give exceptional circumstances and put into consideration the state attorney’ fears Samari Wakholi that once they are granted bail they could interfere with the investigations which are in the final stages.

While denying them bail, justice Kabanda left an allowance for the applicants to file a fresh application for bail if Nakawa Magistrates court fails to commit the accused to the high court in the next siting which is due on the 17th of this month.

The applicants had given six grounds for their application including bail being his constitutional right, fixed place of abode, having no criminal record, will not abscond from attending court and substantial sureties who included amongst others Winnie Byanyima, Hon. Capt. Gasatura George, Edith Byanyima and Martha Byanyima though this was objected by the state attorney.
