Deputy Chief Justice Stephen Kavuma has today morning refused to step aside from hearing of an appeal filed by Rubaga South MP Hon Kato Lubwama before the Court of Appeal.
While delivering Justice Kavuma’s ruling in a fully packed registrar’s chambers , the Deputy Registrar Deo Nzeyimana, pointed out among other things that in Uganda, legal practitioners have no right to decide on which judge should hear their matters.
Buwembo’s lawyer Isaac Ssemakadde of Legal Brains Trust (LBT) expressed worries on Justice Kavuma’s participation on the panel of the three judges to rule on Lubwama’s petition against High Court Judge Justice Oumo Oguli ruling that granted Buwembo permission to file an election petition after the legally specified time had elapsed.
Ssemakadde had filed an application challenging Kavuma’s presence on the panel, claiming that he doesnt expect justice from him citing the several complaints against him, his competence and character.
speaking shortly after the ruling Ssemakadde revealed that they will not challenge the ruling however they will forever Justice Kavuma’s conduct
On his part Kato Lubwama said that the ruling is a sign of victory before bragging of how he is blessed by God hence cautioning his opponents not to mix political matters to court.
This appeal application was assigned to a panel of three justices including Stephen Kavuma, Hellen Obura and Cheborion Barishaki
