State minister for Labour, Employment and Industrial Relation and also Rukiga County Member of parliament, Hon Herbert Kabafunzaki has been granted bail by the Anti-Corruption Court judge Agnes Alum, after a night on remand at Luzira Prison over corruption charges.
In her ruling justice Agnes Alum found the 3 sureties presented by Kabafunzaki to be substantial and the fact that he has no pending criminal charges against him hen his release on a cash bail of Shs. 5Million while his three of his sureties were bonded at Shillings. 50 million.
Eliab Byamukama a lecturer at Kampala International University, Charles Mutabaazi, and Doreen Kabafunzaki who happens to be the wife, were the sureties presented by Kabafunzaki.
In the same way as one of the bail conditions, the court retained the minister’s diplomatic passport and the certificate of his plot of land at Ndejje in Makidye Ssabagabo Municipality Wakiso district.
However the senior state Attorney Maxim Elizooba yesterday had objected the release of the minister on bail. He argued that since the minister was caught red-handed receiving a bribe, chances of him fleeing are high once released on bail. Before asking for stringent condition including hefty amounts of money, passport deposit and a land title in case he is found fit to earn a bail.
The same court has also convicted Mr Brian Mugabo, 21, a political assistance to the minister who pleaded guilty to the charges and set the 19th of this month as the sentencing date.
In the same way court has set tomorrow the 14th of this month as date for the bail hearing of Mr Bruce Lubowa, 42, an interior designer in Wakiso District that was with the minister at the time of arrest.
The Minister was yesterday charged before the Anti-Corruption Court with soliciting and receiving a Shs5 million bribe from Aya Group chairman Mohammad Hamid which is contrary to Section 2(a) and Section 26 of the Anti-Corruption Act, 2009, and one count of conspiracy contrary to Section 390 of the Penal Code Act.
He denied the charges, and in a brief interview with the press yesterday labeled is arrest as a concoction and political witch hunt.
