Following the high court decision at Twed towers under justice Patricia Wasswa Basaza on june 21 permitting kabaka to appeal against the directive to hand in all kingdom account details of bank of africa and stanbic on addition to all land tittle detail, the judge has found no grounds of objection for the defence (Male Mabilizi Kiwanuka).
Among the grounds mabilizi contended included powers of attorney where he claimed kabaka’s lawyers led by Christopher Kiwanuka had no direct orders from the kabaka instead from the kingdom legal team contrally to the oath act, kabaka being a custodian and the documents being of value to his main suit.
Basaza had briefly on 21st ruled in favour of Kabaka in the same way in a detailed ruling she has re-affirmed her decision and saw value in kabaka’s need to appeal.
On costs, Basaza over rules that any costs will be met after the main suit since all these applications are arising from the main suit.
Apparently the same court is hearing an application of stay of execution where kabaka wants the directive of him handing in documents like he was ordered.
Kabaka says that since the court has okayed him to appeal aginst the court decision, then the directive should also be stayed.
