Pte Herbertson Birivumbuka, a UPDF soldier attached to the Special Forces Command has confessed to killing the Mayuge family of five due to revenge has been handed a death sentence.
Appearing before the division court martial of the first Special Forces Group of SFC sitting at Buwaya sub county headquarters in Mayuge district and chaired by Lt Col Moses Nabasa, the soldier was also sentenced to 90 years for the murder of the second victim, life imprisonment for murder of the third victim ,54 years for the murder of the fourth victim and 51 years for the fifth victim.
All were found in the house of Isaac Isabirye Mudhasi, 42.
The court chairman also sentenced the UPDF soldier to 95 years in total for the four counts of attempted murder in regards the people who were injured during the unfortunate incident of shooting.
On the charge of conspiracy to murder, Pte Birivumbuka was sentenced to three years imprisonment.
“These offences are of serious nature and there is need to deter others from committing the same. On the other hand, court has taken into account the mitigation by the defence and thus considered them in sentencing,” Lt Col Nabasa said.
The court chairman said he had considered the four months spent in custody and deducted them.
He said the sentences will run concurrently, adding that the convict will serve the longest one which is death.
He is to serve the punishment at Luzira maximum prison but was told he has a right to appeal within 14 days from the date of sentence if not satisfied with the sentence of the army court.
The court sentenced two civilians Patrick Tagaba and to one year and six months imprisonment respectively at Kirinya government prison to after being found guilty of conspiracy to murder.
On the other side, Sharifu Modasi was set free.
There was ululation when court pronounced itself on the sentence for the UPDF soldier.
