The General Court Martial (GCM) at Makindye in Kampala has rendered a verdict of guilty against two builders and a video library attendant for the charge of aggravated robbery. GCM chairman Brig. Gen Robert Freeman Mugabe delivered the conviction following the trio’s admission of guilt.
The convicted individuals, identified as David Mawanda, aged 30, Gerald Nsubuga, aged 20, both builders, and Ronald Kalusya, aged 20, a video library attendant, hail from Kakuwu, Kitala village, Katabi Sub-County in Wakiso District.
Prosecutors Lt Alex Mukhwana, Private Anthony Phillip Olupot, and Private Regina Nanzala informed the court that the defendants, armed with a firearm, forcibly entered the residence of Allan Mwesigwa in Bwebajja village, Kajjansi Town Council, Wakiso District, on October 10, 2019. They proceeded to tie up his maid and 10-year-old son with ropes before robbing various items, including electronics, mobile phones, ATM cards, and clothing.
The charge brought against the trio is that of aggravated robbery, as outlined in Sections 285 and 286 (2) of the Penal Code Act.

In their defense, lawyers Capt. Simon Nsubuga Busagwa and Private Priscilla Kakande pleaded for leniency from the court, highlighting the defendants’ swift admission of guilt, expressions of remorse, and time spent in remand and lawful custody.
As per Section 286 (2) of the Penal Code Act, the use of a deadly weapon during or in connection with a robbery, resulting in death or grievous harm, carries a penalty of death upon conviction by the High Court.
Following the conviction, Gen. Mugabe ordered the remand of the convicts back to Kitalya Government Prison until March 18, 2024, when they are scheduled to appear for sentencing.
