Petition Against Local Council Term Extension Scheduled for October

The Mbarara High Court has scheduled a hearing for October 14, 2024, to consider an application filed by Mbarara City lawyer Owebeyi James, challenging the extension of the terms of office for Local Council (LC) 1 and II chairpersons.

Earlier this week, Owebeyi petitioned the Mbarara High Court, seeking a judicial review against the extension of the village chairpersons’ terms.

The Minister of Local Government, Raphael Magyezi, recently extended the terms of office for LC I and LC II chairpersons by six months, or 180 days.

The notice of motion, dated July 12 and signed by Mbarara High Court Deputy Registrar Nanteza Zulaika, lists several grounds for demanding judicial review.

A copy of the notice of motion obtained by the Uganda Radio Network reads in part: “Take notice that the court will be moved on October 14, 2024, or soon thereafter as the applicant can be heard for orders for judicial review reliefs to wit, a declaration that the action of the local government minister (Raphael Magyezi) to extend the term of LCs is illegal and unjustifiable in accordance to laws of Uganda.”

The motion further seeks “a declaration that the term of office for LC1 and LCII has expired and they are acting illegally” and “an order of prohibition prohibiting the respondent from allowing the illegal and expired LC1 and LCII to perform the functions of such offices.”

Karungi Betty Gafabusa, the Mbarara Regional Attorney General, confirmed receiving a copy of the notice of motion on Friday afternoon but did not provide further details.
