Kabale MP elect Andrew Baryayanga(AJA) faces arrest as a court debtor over a murder case

The rich do what they can and the weak suffer what they must; An elderly lady’s quest for justice against Hon. Baryayanga Andrew(AJA)  who killed her husband in a road accident

On the 24th May, 2016 tragedy struck the home of the late Amuri Muhamadi when a vehicle driven by Hon. Baryayanga Andrew Aja crushed into the homestead of the late Amuri Muhammed killing him and his pregnant 2nd wife.
Hon Baryayanga is the MP elect for Kabale Municipality and he is now facing arrest following failure to pay compensation in an accident murder case.

The warrant of arrest issued on the 1st of April 2026by the Magistrates court in Ntungamo contains a sum of sh. 46,309,000 and the court bailiffs’ charges are to be added after the execution.
The case background;
The death of the late Amuri left the 1st wife who watched this ordeal helplessly as she had gone across to till her garden.
In a bid to reduce the damage that had occurred, the then Member of Parliament for Kabale Municipality hurriedly entered a memorandum of understanding (M.O.U) with the surviving widow of the late Amuri, Keitumba Maimuna.
In the M.O.U the said Hon. Baryayanga agreed to pay a meager Ugx 18,000,000/= and further undertook to construct the house he had crushed in the accident.
From the documents on the court record, Hon. Baryayanga did not pay the entire money and refused to construct the house he had undertaken to construct.

The elderly widow Keitumba Maimuna who is in her 70s was forced to seek justice in the Chief Magistrates court in Ntungamo in 2020 and indeed on the 10th January, 2023 the Chief Magistrate ordered that the Hon. Reconstructs the house or pays Ugx 18,000,000/= or reconstructs the house. The court also ordered that he pays damages to the tune of sh.15,000,000/-= and the costs of the suit.
JUSTICE THWARTED: when the elderly Keitumba sought a warrant of arrest against the very wealthy Hon. Baryayanga Andrew, he resorted to delaying tactics by filing a baseless appeal in the High Court at Mbarara in Civil Appeal no. 5 of 2024.
The appeal was subsequently withdrawn with costs to Keitumba Maimuna for being incompetent when the same was challenged by Keitumba Maimuna’s lawyers who filed an application to strike out the said appeal in Misc. Application No. 104 of 2024 in the High Court of Uganda at Mbarara.
The said application is pending a decision as to whether the applicant, keitumba maimuna ought to be granted costs upon withdrawal of the appeal by Hon. Baryayanga Andrew Aja’s lawyers.
Other applications in the lower court to delay justice: indeed upon withdrawal of the baseless appeals, leveraging his financial muscle, the Hon. Baryayanga Andrew Aja has filed several other applications to impede Keitumba Maimuna’s quest to get justice and the same are still pending judgment in the court.
The applications seek to set aside the orders of the court to construct the house and the damages and costs the court had awarded.
When approached Keitumba Maimuna stated that the applications seem to be a waste of time but said his lawyers who have helped him since the case started are handling and she will patiently wait for justice to be served.
She also stated that upon the warrant of arrest being issued earlier last year, the Hon. Baryayanga had capitulated and constructed the house although the same is not yet fully completed. This is a ray of hope and indeed she says a poor person can get justice; she says and trusts God and the justice system to prove her right.
She said that owing to her poverty, she occupied it to save on costs of living and is still hopeful that the lord that she serves will bring justice home.
We reached out to her counsel Hategeka Humphrey who stated that since some of the matters were pending determination in court, he could not comment on the subject but he stated that he is hopeful that justice will be served and hopes that Keitumba Maimuna remains patient and trusts the justice system since she has at least got the house reconstructed thanks to the court.
Attempts to reach out to Hon. Baryayanga Andrew Aja or his lawyers for comments have so far been futile.
It is important to note that although Hon. Baryayanga did not plan a road accident; it happened, he survived it, and it is prudent that he compensates those he hurt especially that he is able and has the financial means to pay since he is not poor.
