Exiled Ugandan writer Kakwenza Rukirabashaija has instructed his legal representatives at Kiiza and Mugisha Advocates to pursue legal recourse against the Buganda Road chief magistrate regarding the ongoing offensive communication case against him.

Despite a previous ruling by the Constitutional Court nullifying the section under which he was charged, Kakwenza asserts that the court has persisted in prosecuting the case.

In a letter dated March 2, 2024, Kakwenza expressed frustration with the chief magistrate’s refusal to acknowledge the implications of the Constitutional Court’s decision on his case, emphasizing that he will not tolerate being a victim of judicial obstinacy.

Last year, Kakwenza directed his legal team to cease representing him in the same court following the Constitutional Court’s verdict that Section 25 of the Computer Misuse Act, 2011, which criminalized offensive communication, was no longer valid.

Expressing disdain for what he perceives as the court’s disregard for the law, Kakwenza contends that continuing the proceedings in the face of the Constitutional Court’s ruling would be acquiescing to unjust persecution.

Despite his respect for the judiciary as an institution, Kakwenza condemns what he views as the incompetence of certain judicial officers and public officials who impede his rights and freedom.

Frustrated by the disproportionate impact on his freedom of movement and professional engagements as an internationally acclaimed author, Kakwenza sees no alternative but to confront the chief magistrate through legal channels.

In his directive to his legal representatives, Kakwenza urges them to proceed with necessary legal actions, eagerly anticipating updates on the progress of the matter.
